Texas Bereavement Laws

Bereavement leaves are requested by the employees for the purpose of allowing themselves paid time off for the passing away of their immediate family member, without having to compromise their personal time. There are no federal laws that protect employees of their right to take bereavement leave; the law provides the flexibility of this benefit to heads of agencies and companies so that they may establish bereavement leave policies that are beneficial to both employers and employees. Company policies regarding bereavement are usually derived from collective bargaining agreement.

However certain states have set up their own public policies on bereavement. Texas is one state that has its own policies on bereavement. Texas bereavement laws include the following provisions:

? All full-time and part-time employees who need to leave work for a modest amount of time due to the death of an immediate family shall be granted bereavement leave. Immediate family members are the employee’s spouse, and those that take the place of the spouse. They can also be the spouse’s parents, children, grandparents, and siblings.
? Texas bereavement laws exclude employees who work for less than 20 hours per week; employees who are in the job for less than four and a half months; and employees whose position requires them to be a student as an employment condition.
? The number of days allowable for bereavement leave, as per Texas bereavement laws, depends on the institution with regard to certain considerations like the employee’s relationship to the deceased, the responsibility of the employee at the funeral, and the amount of travel time required to reach the dead family member.
