Florida Bereavement Laws
An individual who experiences death of an immediate family member will naturally be put under grieving process. Bereavement is part of the normal process that is in reaction to loss. For individuals who go through such a devastating experience, the last thing they would want to worry about is their jobs.
Bereavement period comprises of the time an individual need off work to attend to the funeral needs of the deceased and to comfort the remaining loved ones. However, no particular federal law protects an individual’s right to bereavement. States of America have different public policies regarding bereavement, but not all states have laws regarding such emergency leave. Florida bereavement laws are not made available to employees who need protection upon the death of their family member. Because of the absence of such law, they are not assured that they will be granted bereavement leave. No Florida bereavement laws require companies to grant their employees the time off they need while in the process of grieving. Because of this, any employee who takes or requests time off may be legally discharged by his employer from work, compromising his career because of the death of a loved one.
Even if there are no Florida bereavement laws that protect employees, companies still do allow their employees to take bereavement leaves when certain conditions are met. Policies regarding bereavement are left for the company or employer to decide. Employers may set requirements before an employee can avail of this privilege; employers are not legally required to pay bereavement leave.
